I think that's ****. If you're smart enough to learn how to do it, then I don't think you should be jailed for doing it for yourself.
Black Hat:
Have real skill like Regular hackers, but they use it for other purposes. They break into things and destroy things. Another group misunderstood. Who says they aren't the ones keeping other powers in countries from taking over and turning everyone into sheep?
A Black Hat breaks security for their own purposes, while White Hats Break in to see how it works.
Red Hat:
Sell out company. Used to be cool in making *NIX OSs easier to use. Got greedy and said the hell with the none paying user base, and now only sell corporate ****.
Blue Hat: Hacker/Phreaker/Social Engineer like person. Likes to explore and learn how things work, even if some of the things learned would make them criminals if used. Morals separate them from criminals. Blue Hats know HOW to do things that could mess you up, but don't usually use any skills from it to do harm.
Blue Hats know a little of everything from Social Engineering, to phreaking, to hacking, to being damned creative. I am a Blue Hat. And I just made that whole thing up.
Whackers: Mythical. Break into anything they can and destroy as much as possible. Make Black Hats seem like innocent school children. They are electronic terrorists.

Personally, I don't have a problem with crackers (i.e. the free software types) as long as they pay for software, (i.e. compilers that have been used for monetary gain, etc) as soon as they can (most people can't get the capital needed to shell out for a huge piece of software before selling any of it).
But, just to be devils advocate, if the software was being made freely to everyone, how would they make profit out of it? Think of the resources put into development, and then think how would they make profit, if it were legally available to everyone, as simply as by lending your mate a cd? In a way, it's comparable to slave children in africa, who make something of decent quality, and they then see minimal profit on it...

As for the original question, very few people will use 'real' DOS nowadays, because it has somewhat limited capabilities... for example not being able to multitask, and having somewhat limited networking abilities.
I would say (in my opinion) most of the hacks that you hear about on CNN/BBC would be using *nix, because of the large array of scripts and tools available for it, hence they would be able to do something noteworthy... most viruses would be written using windows, as most viruses are for windows, and it would be easier to test them that way (hehe, just imagine virusing your own PC, so you can't get the virus executable, while trying to test it). Then there'd be a limited amount that uses windows, because it's the family PC, or the one down at the cyber cafe.
