You have to register it and let the feds decide, failure to do so _could_ fall under anti-terrorism laws since encryption devices are classified as munitions.

The lack of selling is critical here and means posting about it would fall under freedom of speech and not exportation, the only exception would be if it were a national security issue, but I gather he hasn't spoken to the government at all, much less about national security.
