need help with spammer
what legal action can be taken against spammers who hi-jack someones server to foward spam?

When you say they hijack someone's server, do you mean they just use it or do you mean they take control of it?
If they just use it because it's an open mail relay, then change the configuration ...
It will depend how well you can track them down to decide what can be done against them ... and on their geographical location ... if they are not in the US or Europe, there may be very little you can do.
You could always try to go after them for using up your resources ...
