Public hotspots
I have always been wary of public WiFi hotspots and the cowboys who think that it is smart to piggyback on an unsecured connection.
I came across this quote:
Experts said that if a person is comfortable with shouting the information that he or she is working with on their computer from a tall building for everyone to hear, then there should not be an issue. Otherwise, he or she might be taking chances.
In the case of private unsecured hotspots there is also the question of whether you will still own your computer when you have finished using it.
Story is here:

So, I guess it's perfectly legal to do packet captures at the coffeehouse, eh?

In a lot of places it probably is; after all it is a broadcast in a public place isn't it?
I think that the illegality comes with what you do with the information
