If they're going to go with legal action against this man he could easily get out of it with a decent lawyer.
Do they go out in the street and offer a guy the dvd, then tell him to give it back, and then arrest him if he doesn't?
They own the copyright, so they can give it away for free, and it is perfectly legal to take it.
Now if it was somebody who doesn't own the copyright is giving it away, it's a different story.
edit: By they I mean the motion picture company, IBM has every right to fire the guy for misuse of their computer system.
