Hes a dick about it, then load up your fav file sharing network max the bandwidth and let it go for ever, he will be forced to fix your/his problem and you get mega porn and tunes yaaaaaaa (everyone wins), Thats what i would do if an offer of help securing his network was rebuffed.
You don't mention what make/model of PDA it is but does it not have an option to only connect to encrypted networks. Other than that it may be worth changing the channel your WAP is set too, if you are in close proximity and both WAP's are on the same channel his may be interfering with yours. May be a long shot, just an idea.
If you are using 802.11b/g then channels 1,6 or 11 are probably the best to try as they are the non-overlapping channels I think.

ironically enough both him and i are transmitting on channel 6 (because that is what my pda picks up the quickest)
my pda is a dell axim x3i, so i did find a way to make it so it doesn't connect to "non-preferred" networks, however because his network doesn't have encryption and mine doesn't broadcast ssid, then it configures his network as a "preferred" network because after i bring my pda to work and it connects to a different network, it "forgets" what my network is/what it is supposed to connect to
Do you know if he has changed any of the setting since taking it out of the box?
If he hasn't changed the default username and password on the router...
Why not log in to his router and block your PDA's MAC from that router?
That'd fix it from connecting all the time...
If he really won't do anything about it... do it yourself.... or like others have said:
Suck up his bandwith... LoL
Just make sure to download really large files... like Linux Distros!
Just go in there and delete them from time to time so it doesn't use up all your diskspace...
I've found freshdownload to be a great tool! You can configure it to download 3 at a time and if it gets cut off... it'll pick up right where it stopped! Set like 6 ISOs on there from different servers... you should be set.
hehe go with lumpy's idea. download an obcene amount and be as obvious as possible while doing it, this way his isp will wonder whats going on and no more networking problems for you. because he will no longer have a network. :)
[off topic- this thread / set of threads has given me the best laff of the day so far. I tried reading it as it first appeared, then memory's post lost me, there was a reference to SwordFish_13 who (as far as I could tell) hadn't even posted, then the post appeared on the next page ???? under a different title. Bust his sorry ass by maxxing out his bandwidth, do it at peak times, both for the cost to him as well as the chance of stopping him from playing with the big boy toys.....

When you see him get home (whenever he gets home) get a laptop connected to his network and steal his bandwidth however possible. Download *nix ISO's and the biggest files you can possibly find on any filesharing network (shoot, use K++, Bearshare, and WinMx all at the same time). Then he might figure out something fishy is going on and beg you for help :D
oddly enough, he has changed the router's default name and password, but for some reason didn't enable wep (he doesn't understand computer security at all. what i am thinking about doing is rather than running my FTP server off of my network, i will just run it off his since when i run it on mine it cripples my network (figures i would go from college to home and i keep paralyzing my own network ;))

Then go ahead and point out to him that since you are clearly doing it the probablility is high that every other Tom, Dick and Harry are doing the same too. This being the case it'll only be a short time before his ISP cut's his internet access off for abuse. Hopefully, that'll get his attention and you can teach him MAC Filtering and Mandatory WEP. He will be a happy bear and so will you.
