I've got a couple of good reasons why he doesn't deserve jail time. I read the article in full and it was his kitten, not some poor little kid's. At any point in time he can decide to end the kittens life. Most of the time this is done humanely at an animal shelter, but I'm sure people shoot horses. (Which may still be humane) Now lets take animal testing into account here. (The following is a hypothetical) Dr. Jones decides to test Vioxx on his lab cat. The initial batch of Vioxx causes the cat's joints to swell tearing all of it's tendons and ligaments. The cat is now hobbled and in severe pain for the rest of it's days (Not too many). The cat now looks like the stay-puff marshmellow man (ghostbusters) and the doctor invites his fellow doctors and the hot intern to look on as the doctor pokes fun at the cat for the duration of its life (The doctor kills the cat after the joke wore off). This too is "sick". But the fact of the matter is that regardless of this mans ability to judge between "good and evil" he didn't commit any real crime. No property damage, no harm to another (human), or anything else. Calling the police to break up the barbeque would be acceptable just because others may not want to see it or smell it. But 5 years in jail for violating a social moray?
But the thing is it IS illegal. Mistreating an animal is against the law, and you can be arrested and fined. Shooting a lame horse may still be done, but in this case, is to put the animal out of it's misery. And even in the extreme circumstances that you mentioned with the animal in a testing facility, that is done in the interest of science. However, animal testing is usually done in lab rats, not cats. No one uses cats. Them poking the said cat afterward is still sick, and I'd still beat them with a Louisville Slugger. And once the experiment was over, scientist and experimenters would euthanize the animal afterward. My wife did this for years in a pych lab with rats, so I'm not coming at this blind.
You are obviously not a pet owner, or you'd understand. You can not just abuse an animal just because it is yours. Your kids are your own -- doesn't give you the right to torture or kill them. Same with any animal -- treat it as if it were your child. If they wanted it put down, they could have taken it to a vet. They were obviously torturing it for their own warped, twisted amusement, and I will take delight when they are incarcerated. Animal abuse is against the law for a reason.

My mother once saw a kitten she had to have, and when she knocked on the door to see if the guy is giving them away. The man claimed he sold them to the labs by the batch, and needed them money, so she would have to pay him $20. for the kitten.

This story is so terribly sad. I have 5 new kittens of my own, and it would crush me if someone burned of mine. That is just sickening.
