Soule, I can see your point. My opinios is based only on statistics regarding drunk drivers. 40% of all fatal accidents are caused by alcohol, however only 1% of all drivers are intoxicated. That makes you 40 times more likely to kill someone when you drive drunk. (That's my interpretation of the stats, anyway.) However, I have not yet seen any statistics showing whether or not smoking pot or talking on a cell phone or speeding in parking lots has the same effect. Driving while exessively fatigued should be a crime too.
But let's follow that logic the other way. What about people who hit pedestrians when they get in the way? Maybe people should be allowed to drive on the sidewalk when the road gets too full. What about people who have drank too much and can't stand anymore? At least driving a car they're sitting down and won't fall. Surely you must agree that at some point, dangerous driving must be illegal.
But in general, I would think that doing *anything* while in control of a half ton block of steel moving at 60 miles an hour that endangers the life of others should be a federal offense. But where to draw the line? That's a good question.
I guess the difference with drunk driving is the education factor. Everybody knows what alcohol does to them behind the wheel of a car, unless they've been stuck under a rock for the last 20 years. But some people choose to drive this way anyway. When people intentionally make the choice to risk other people's lives more than necessary, they should be committing a crime.
