Here's a link to an article I found, about a spammer getting fined for sending out emails. Below is a summary of the article.
Heckel argued the e-mail law enacted in 1998 is unduly restrictive on legitimate business. But the only burden the act places on spammers is the requirement of truthfulness. The law bans commercial e-mail with misleading information in the subject line, an invalid reply address or a disguised path of transmission across the Internet
