I can't stand my school...
Alright, i go to HS, and recently, they've made some major changes to student priveleges. Someone pointed out ( on an online message board, off the school servers) that it was because of the new administrator (Vice Principal) that we've hired, and went on to say something about his mom in the post...Well, that person is in trouble, because it is supposedly in the schools power to suspend people for stuff they posted online, on a non-school server, because the forum name was marked "School".
They forced the Admin of hte message board to give up names to.

I am a little confused:
They forced the Admin of hte message board to give up names to.
If it is a school board......it is theirs? if it was a privately hosted board............I would suggest offences against the fourth amendment as a minimum?
Just my confusion....I am sure (up to 4500 with a lite 50 )
And if they have problems about anything that I post marked "school" they have one hell of a problem....I, on the other hand, do not

EDIT: you use the word school differently from us?..HOW OLD WAS THE PERSON?..did he have a family representative or lawyer present?..just a few thoughts?
Of course.........you would never like to attend a school that I ran?.......the electrodes would make sure of that

The message board was run privately. They basically told the Message board admin that he had to give the names up or he'd be in trouble for "Verbal Assault"

How was the Admin "forced" to give up the names? Was a warrant issued?
If no warrant was issued, might be worthwhile to have a little conversation with the press. A Private board where conversations go on and there IS some expectation of privacy (due to the fact that it's students only) might have some local state law privacy issues.

The owner of the message board needs to check his TOU when having people sign up for an account to make sure he can not be held responsible for the content posted on his board. Once that is done, a school can threaten all they want, and can't do **** without a warrant.

My advice.............lawyer and the press...........name them and shame them.
OK my laws are English/European...............but "verbal assault" is what it says....."Verbal" and "assault", is as in face to face confrontation...........NOT behind the back.
Now "libel" (published) and "slander" (spoken) are different..........then you have to go for "fair comment", "absolute truth" or just plain "vulgar abuse" as defences?
I do not know the circumstances, but the admin of the bulletin board might like to consider the way in which he/she was approached? that could well be construed as "assault" particularly IF THEY ARE A MINOR? Perhaps the police might need to be involved?
Well it DID provoke a reaction.............makes me wonder just who should be wearing short pants and taking the short bus?
