B. Whoever commits extreme cruelty to animals is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978.
C. Cruelty to animals consists of a person:
(1) knowingly or recklessly mistreating, injuring, killing without lawful justification, torturing or tormenting an animal; or

yeah it's just a cat, it isn't even a conscious creature all this is true...but it's a living creature that suffered unecessary pain not because of nature but simply because of the violence brought by a living creature. No where else in the animal kingdom do predators kill thier prey just for the fun of it. Yeah, we eat cows but they're killed (somewhat) swiftly and painlessly, and we're killing them for nourishment to ensure our survival. Survival of the fitest...chain of life. Evolution. It's inhumane and although I go by a philosophy that says basically "so-what" still...it's just a senseless act of violence against a defenseless creature, something someone with a sick mind does.
I actually found that tape on gnutella ya'll...it's some really disgusting **** :-&
it's amazing how fast the tape got onto the net

That could be challenged: Cats by nature have the instinct to hunt, and because we feed our cats they do not have the need to eat the rodents and birds they catch.
Again this is an act of nature, and I had a feeling someone would argue the statement of killing prey for fun.

Okay, I can not argue with what that laws says. I concede that point although I do not agree.
No I don't think that those kids with the cat in Cali are criminals either. Whether or not someone is sick isn't for us to pass judgement on. It's a *****ing cat, who cares whether or not some twisted person wants to torture his/her cat. Hypothetically lets say person a wants to torture his cat when he is 12 years old or whatever age. When it is all finished and now his sisters cat is dead and he cannot bear the remorse of seeing her cry. Scarred for life and it won't happen again. Jail time = unrecoverable person (not ALWAYS the case but...) Again same hypothetical but John Doe feels so bad after torturing the cat that his total "sickness" goes away, preventing the death of 12 others he might have killed in the future had he not done that to the cat.

Wrong. Wolverines kill there prey for the sheer enjoyment. I once heard a rancher tell of a field of dead deer with their throats ripped out, done by a wolverine. None of the deer had any part of them used for a "sensible" nature.
actually I'm not going to get a copy. I'm just debating for the fun of it and because albeit "sick and twisted" I do not feel it is a crime that should be applicable in todays society where god has so little a part. I have no interest in seeing an animal tortured. (Except for my neighbors dog...j/k)

I've got a couple of good reasons why he doesn't deserve jail time. I read the article in full and it was his kitten, not some poor little kid's. At any point in time he can decide to end the kittens life. Most of the time this is done humanely at an animal shelter, but I'm sure people shoot horses. (Which may still be humane) Now lets take animal testing into account here. (The following is a hypothetical) Dr. Jones decides to test Vioxx on his lab cat. The initial batch of Vioxx causes the cat's joints to swell tearing all of it's tendons and ligaments. The cat is now hobbled and in severe pain for the rest of it's days (Not too many). The cat now looks like the stay-puff marshmellow man (ghostbusters) and the doctor invites his fellow doctors and the hot intern to look on as the doctor pokes fun at the cat for the duration of its life (The doctor kills the cat after the joke wore off). This too is "sick". But the fact of the matter is that regardless of this mans ability to judge between "good and evil" he didn't commit any real crime. No property damage, no harm to another (human), or anything else. Calling the police to break up the barbeque would be acceptable just because others may not want to see it or smell it. This is a stretch here but It's not "okay" to do it. Nor is it right. But who are you to pass judgement of john doe it he wants to kill his cat a cruel way. What about fish, do they not get the same right as cat (don't post that law again, I read the whole thing already). They get hooked in the mouth dragged ashore and suffocated and then filled with a jagged knife in some guys house. Gee, if we weren't eating the fish that sounds like torture to me.

I think you have proved your point by standing up for others that have the same problem as yourself. You do not partake in the consideration for others, nor do you have the ability to show compasion. You know that is a sickness. For you to think that these acts are okay, and the fact that it does not affect you in the slightest way is unhuman. If you could watch these actions being perfomed without a tear in your eye, or atleast a bit of sorrow for the animal in question. I would say you are one sick M-F'er..... I really had enough of your ignorance, and I really hope you are doing this for attention so others would reply to your posts, because if this is how you feel. You seriously need some help....

the way you were portraying it. it was if u did agree im not passing judgment if u r talking to me.
what about fish they have a brain span of 2 second`s a bit like your self thus they wouldnt feel pain

You obviously missed my whole point. What business is it of yours or mine to send someone to jail for lacking empathy? They did not harm anyone or anything that falls under the scope of humanity. And what business is it of your to pass judgement on me. So why don't you f* off if you're gonna do that.
Now this discussion has degenerated into the replies containing no more good points except insulting me. So that proves who really has a two second brain span.
