You have really raised an interesting one there Mr Aurora Borealis
Basically it would depend on copyright laws in the particular country, and any reciprocal agreements they had with the country in which it was published. Within the same country, then local copyright laws will hold good.
It is really no different from publishing an image in a book, magazine or newspaper. if you can prove that it is your intellectual copyright, then they have to remove it. Because the internet is pretty free at the moment, removal is probably about the best that you could hope for. I doubt if you could claim much above your legal costs, if that. This is because they can actually remove it..........if I have printed an distributed 5million newspapers, then obviously, I cannot.
A lot of ISPs can see what is coming and do not want to upset important corporate clients, or potential clients. They may well suspend their service to the infringing party if you complain BUT be sure that you can prove it, or you may end up on the wrong end of a lawsuit yourself
If it is your personal photograph, taken in a public place, then I would probably get away with it in the UK.............unless, of course, I added your name, address, car registration and a price
Otherwise, local privacy protection laws would apply.
